Terms of Service

These Terms of Service (“Terms”) govern your use of Myndfold's mobile application and website (collectively, the “Service”), operated by Myndfold (“we”, “us”, or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By accessing or using Myndfold, you confirm that you are at least 13 years old (or 16 in the EEA), have the legal capacity to enter into a binding agreement, and agree to these Terms and our Privacy Policy. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Description of Service

Myndfold is a visual AI planning application designed for neurodivergent minds, including individuals with ADHD, ASD, anxiety, and related conditions. The Service includes:

• ‣Task and routine management with energy-aware planning
• ‣MyndTap NFC sticker support for physical-world task triggers
• ‣Community features via The Fold (Pro plan)
• ‣AI-assisted planning suggestions (Pro plan)
• ‣Family account sharing (Family plan)

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Plans and Subscriptions

3.1 Free Plan

The Free plan provides access to core Myndfold features — unlimited tasks, energy check-ins, basic routines, and MyndTap NFC support — at no cost, forever. No credit card is required to sign up for the Free plan.

3.2 Fold Pro Plan

Fold Pro unlocks premium features including Momentum Paths, The Fold community, Fold Partners, misophonia-safe sounds, unlimited routine templates, and priority support. Fold Pro is available as a monthly or annual subscription. Annual subscriptions are billed once per year and offer a discount compared to monthly billing.

3.3 Family Plan

The Family plan provides Fold Pro features for up to 6 accounts and includes a shared Family Fold space and shared routine templates. The Family plan is billed annually only.

3.4 Billing and Cancellation

Subscriptions are processed through the Apple App Store or Google Play Store. Payment, billing, refunds, and cancellations are handled in accordance with Apple's or Google's terms, as applicable. You may cancel your subscription at any time through your device's App Store account settings. Cancellation takes effect at the end of the current billing period; you retain access to Pro features until then. We do not offer refunds for partial subscription periods except as required by applicable law.

3.5 Downgrade Policy

If you downgrade from a paid plan, your Pro features are paused, not deleted. Your data (Momentum Paths, Fold settings, etc.) is preserved and will be restored if you resubscribe.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• ‣Provide accurate and complete information when creating your account
• ‣Notify us immediately of any unauthorised use of your account
• ‣Not share your account credentials with others (except via the Family plan's intended sharing features)
• ‣Not create accounts using automated means or under false pretences

5. Acceptable Use

You agree not to use the Service to:

• ‣Violate any applicable law or regulation
• ‣Harass, abuse, or harm other users
• ‣Upload or transmit malware, spam, or harmful content
• ‣Attempt to gain unauthorised access to any part of the Service or our systems
• ‣Reverse-engineer, decompile, or attempt to extract the source code of the app (except as permitted by applicable law)
• ‣Use the Service to create a competing product or service
• ‣Interfere with or disrupt the integrity or performance of the Service

We reserve the right to suspend or terminate your account if you violate these acceptable use requirements.

6. User Content

You retain ownership of all content you create within Myndfold (tasks, routines, notes, etc.). By using the Service, you grant us a limited, non-exclusive licence to store and process your content solely for the purpose of providing the Service to you. We will not use your personal content for any other purpose.

You are responsible for ensuring that any content you submit does not infringe the intellectual property rights or other rights of any third party.

7. Intellectual Property

Myndfold and all related intellectual property — including the app design, branding, logo, source code, algorithms, and all Myndfold-created content — are owned by Myndfold or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in or to the Service or our intellectual property beyond the limited right to use the Service as permitted by these Terms.

You agree to indemnify, defend, and hold harmless Myndfold and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third party's rights.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware. If you are a consumer resident in the European Union or United Kingdom, you may also have the right to bring claims in the courts of your country of residence.

We may update these Terms from time to time. We will notify you of material changes by updating the “Last updated” date and, where appropriate, by sending an in-app or email notification. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
